Selling a Probate Property That Was Used as a Vacation Rental or Airbnb

Inherited a home that was formerly an Airbnb or short-term rental in Oceanside or nearby San Diego County?

If you're the executor or heir, converting a former vacation rental into a successful probate sale comes with unique challenges. From city permit rules to tax reporting and tenant concerns, here’s what you need to know.

Step 1: Cancel Any Active Bookings and Notify Platforms

Many vacation rentals have future guest reservations. As the estate representative, you should:

  • Log into Airbnb, Vrbo, or direct-booking sites to pause listings

  • Cancel all future reservations and notify guests proactively

  • Review account payout information to track outstanding earnings

Remember: All income earned after the date of death belongs to the estate, not the decedent personally.

Step 2: Review Short-Term Rental Permits or City Restrictions

In cities like Oceanside, Carlsbad, and Encinitas, short-term rentals often require:

  • A valid short-term rental permit

  • City-specific occupancy taxes or transient occupancy tax (TOT)

  • Annual renewals, safety inspections, or zoning compliance

If the property no longer meets local STR rules, it could affect how you market or price the probate home.

Step 3: Identify and Report Rental Income and Expenses

Your probate attorney or tax advisor will help document:

  • Rental income received by the estate

  • Depreciation and expenses related to the short-term rental

  • Whether any personal property (furnishings, appliances) are included in the sale or should be valued separately

All of this must be disclosed in probate accountings and may impact estate tax filing.

Step 4: Decide Whether to Sell Furnished or Remove Rental Contents

Vacation rentals are often:

  • Fully furnished with décor, linens, and kitchen items

  • Equipped with keyless locks, cameras, and Wi-Fi routers

You can sell as-is, furnished ideal for investor buyers or remove the contents and stage the property. This decision affects your market strategy and buyer pool.

Step 5: Choose a Probate Real Estate Agent Familiar With STR Sales

Work with a probate real estate agent in Oceanside who understands:

  • STR zoning laws and buyer concerns

  • Probate court timelines and paperwork

  • Local investor marketing, 1031 exchange buyers, and cash buyer options

This helps minimize days on market and ensures full legal compliance during the sale.
